1778 Revolutionary War Trio of Court Documents Relating to Committee of Safety & State of Massachusetts Smuggling
October 15, 1778-Dated Revolutionary War Period, Three Related Manuscript Court Documents, Regarding a case of Smuggling of Sugar in Attleboro, Massachusetts, and its Confiscation, to dispersal, half to the "Committee of Safety" and half to the the "State of Massachusetts," Choice Very Fine.
A rerely encountered lot of Three Related original Manuscript Documents each dating in 1778. This three-piece grouping covers the legal appeal by a Christopher Clarke of Norwich, (Conn.), that errors had occurred in a previous court ruling relative to some Ten Hogsheads of sugar that were confiscated from him, presumably because they had been smuggled them into the Colony. Signed by Samuel Winthrop, Manashe Smith, and John Porter (Sheriff).
1. October 15, 1778-Dated Document is the original Revolutionary War related Court Complaint Document, 2 pages, measuring 7.5" x 6.25" with its official paper and wax Seal fully attached at upper left, choice Very Fine. A boldly written, easily readable Legal complaint by the "State of Massachusetts Bay in New England to the "Committee of Correspondence Inspection and safety of the town of Attleborough for the year 1777, providing a "Writ of Certiorari" with text from October 15th, 1778. Original notification Signed, "John Porter D.(eputy) Sheriff" written as an integral back page leaf, excellent overall with just one short fold split. His prior notes are dated September 21st 1778 regarding notification, which have been crossed out on the back. Docket reads: "Citation for Attleboro Committee". Final decision of adjudication taken at Boston.
2. Companion Documents the record confiscation of the 10 hogsheads of sugar and its forfeit to the Committee of Safety, and half to the State of Massachusetts, due to smuggling, Choice Very Fine.
3. Forfeit Document regarding the sugar's ultimate dispersal -- half provided to the Committee of Safety, and half to the the State of Massachusetts, a True Copy, measuring 3.75" x 6", Choice Very Fine. Unfortunately for Christopher Clarke, he lost his appeal and his sugar.
