ADS, 1p, Marion County, Texas, August 18, 1862. Oath of office for Hilliard Hasty, Marion County Treasurer. "I.... do solemnly swear that I will faithfully and impartially discharge and ... perform all the duties incumbent upon me as Treasurer [of] the county & State of Texas agreeable to Constitution and Laws of the State of Texas and also the Confederate States of America, so long as the State of Texas shall remain a member of the Confederacy..."
It is the second paragraph of the oath that is particularly interesting: "And I do further solemnly swear that since the 2d day of March ...1861 I being a citizen of ... the state have not fought a duel with deadly weapons in the State nor out of it nor have I sent or accepted a challenge to fight a duel with deadly weapons nor have I acted as second in carrying a challenge or aided or assisted or advised any person thus..."
Although most of the northern parts of the United States saw a dramatic decline in dueling at the beginning of the 19th century, it was still common in the south and west. It has been suggested that its popularity in the South was in part because of the cultural emphasis on status and honor, and the need to defend them.
Texas seceded from the United States on February 1, 1861, but did not join the Confederacy until the 2nd of March, the date to which the laws of the Confederate States of America applied. Many argued that it should return to its status as an independent Republic, but a referendum indicated that the majority wanted to join the larger polity.
