Terms & Conditions

Please read the following "Terms of Sale" carefully. These terms are applicable to all bidders, collectors and dealers alike. Your submission of bids in this auction constitutes your acceptance of these "Terms of Sale." It is solely the buyer's responsibility to be knowledgeable about the condition of a lot before bidding. Auction items will be available for preview two weeks prior to the auction on the dates listed on the front of the catalog. Prospective bidders should review all the information and consult about any lots before bidding to determine its condition, size, and whether or not it has been repaired or restored. Please, inspect images closely as they comprise a large part of the condition report. We provide a description of the lot and you are encouraged to ask questions and/or request additional photos prior to bidding. While we do our best to assist with descriptions, it is your responsibility to inspect and assess the condition, wear, authenticity, size, date, provenance, rarity and value of auction items. Our staff will give you our opinion of condition, answer any questions, and send photos if necessary. Email santelmoauctions@gmail.com for queries. All items are sold “as is,” and neither Auctioneer nor any consignor makes any warranties, express or implied, with respect to the item(s). No statement made at auction or in a statement, invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability. If you intend to plug in any electric items, you should first have a licensed professional inspect/service such items. All items are sold for display purposes only and with no warranty for electrical or mechanical components. The price estimates that appear at the end of each lot description are approximations of the range in which the price may fall. Some items are subject to a reserve, the price below which an item cannot be sold. The reserve usually is less than the low estimate. In any event whether or not a lot is subject to a reserve, the auctioneer may reject any bid or raise not commensurate with the value of the lot. The highest bidder acknowledged by the Auctioneer will be the purchaser. In the event of the dispute between bidders, or in the event of doubt on our part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. A 25% Buyer's Premium will be added to the "hammer price" (the final bid price of an item sold prior to any additional fees or premiums that may be charged) and is payable by the buyer as part of the total price for each lot purchased. If you bid successfully, you will receive an email notifying you once the sale has concluded, that includes the hammer price + buyer's premium + sales tax (if applicable) + shipping cost. Invoices are sent via email within 72 business hours after the conclusion of the auction. Full payment is required within 3 business days. If payment is not received within three (3) business days of the sale, we reserve the right to cancel sale and resell merchandise. If you have not contacted Zeitgeist Gallery to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice. If you choose to pay by credit card, please note that we impose a surcharge of 3.5% on the transaction amount on all credit card transactions, which is not greater than our cost of acceptance. Add $15 for wire transfers. Full payment includes hammer price, buyer's premium, shipping cost and all applicable taxes. Once payment is completed, it will take 3 days to process, package and ship your items out. Zeitgeist accepts payments through: - Visa - Mastercard - American Express - ZELLE - Wire Transfer - Cryptocurrency - Stripe SALES TAXES Unless exempt by law, the purchaser will be required to pay the Miami sales tax or any applicable compensating use tax of another state on the total purchase price. The rate of sales tax in Miami is currently 6.5%. Tax exempt clients must provide our office with a copy of their valid resale certificate prior to bidding
