Terms & Conditions
Terms and Conditions of Sale:
When you register to bid in a Wiederseim Associates, Inc. (WAI) auction, you agree to all terms and conditions below. By agreeing to these terms and conditions, you are entering into a legally binding contract to pay for any items on which you have bid and won during the auction.
Key Points:
* All items are sold as is / where is
* WAI does not ship
* Payment is due within 10 business days of the sale
* All sales are final
These are the complete and only terms and conditions on which all property is offered for sale. WAI retains the right to bar any Bidder from participating in any auction, to exclude or reject any bid, to re-open the bidding on a particular item and reserves the right to withdraw any property prior to an auction.
1 CATALOGUE DESCRIPTIONS WAI has endeavored to accurately describe all items being sold, but all property is being sold ‘as is’ / ‘where is’, with all faults. Our printed materials are meant merely as a guide, not a guarantee of accuracy.
2 INSPECTION & CONDITION REPORTS Since all items are sold “as is”, “where is”, with all faults. We strongly recommend prospective bidders to personally examine all items of interest prior to bidding. Your bidding will signify that you have examined the items as fully as you desire, OR that you have chosen not to examine them. The bidder examines the items and accepts it ‘as is’ and relies solely on his own information and inspection.
All lots are available for inspection during the Auction Preview. If a lot description contains the phrase “AS FOUND” it indicates that there are general “issues”. Conversely, the absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Buyers interested in the condition of an item are encouraged to contact WAI and, to the best of our ability, we will document for the prospective Bidder the condition status. Condition is always a subjective evaluation – it is an opinion and should not be regarded as a statement of fact. Final responsibility rests with the Buyer to assess the condition of any item sold by WAI.
3 BIDDING INCREMENTS The following increments are used at the auction. The Auctioneer retains the discretion to change increments and further reserves the right to reject any bid or raise in bid. Absentee bids must fall within these increments. WAI will automatically adjust any absentee bid to the closest increment if the bid falls outside the published range of increments.
$0 – $500: by $25
$500 – $1,000: by $50
$1,000 – $2,500: by $100
$2500 – $5,000: by $250
$5000 – $10,000: by $500
$10,000 – $20,000: by $1,000
$20,000 & up: Auctioneer’s discretion
4 BIDDING Absentee, telephone and internet bidding is offered as a free service to our customers and prospective Bidders. WAI is not responsible for any errors or failures in executing bids, either absentee, telephone or via the internet. The Auctioneer is not liable for, nor has control of, online transmission speeds or bid increments placed by registered online users. WAI cannot warrant or guarantee any phone or absentee bids made or altered on the day of the auction. All bids must be placed in U.S. Dollars and reflect the bid increments as defined by the Auctioneer. WAI reserves the right to limit lots offered for auction online.
ABSENTEE bids are accepted by registering on the WAI website or other identified bidding platforms. Bidders known to WAI may leave an absentee bid in person during the auction preview. Absentee bids placed on our website must be received no later than 12 hours prior to the start of a sale and will not be accepted after that time. Absentee bids left on the identified bidding platforms are done so per their terms.
PHONE bidding is available on a first come, first served basis and requires a minimum opening start bid of $500.00 USD. To register, Bidders must 1) create an account via the WAI website (wiederseim.hibid.com), and 2) register specifically for the next auction and indicate “I’d like to bid by telephone.” Bids must be submitted and confirmed no later than 24 hours prior to the start of the auction. No phone bids will be accepted after that time.
INTERNET bidding is available through Bidsquare, Invaluable, LiveAuctioneers or another third-party bidding platform. These bidding platforms do not communicate with one another. There may be terms which apply solely to when using these platforms and should be reviewed prior to a sale. WAI is not responsible for the content, privacy policies, or practices nor any failure to execute a bid and shall have no liability to any Bidder for any technical or other failure associated with an internet auction. We are unable to confirm online bidding results or receive payment until the auction has ended.
5 PURCHASE PRICE & PAYMENT The “Purchase Price” for each lot is equal to the Hammer Price (HP), a Buyer’s Premium (BP), and sales tax, if applicable.
Payments are due within 10 business days after the date of the auction with cash, check, credit card or wire transfer. Bidders from outside the continental United States may be required to pay via wire transfer unless previously known to WAI. Online platform Bidders may pay directly through their invoice with a credit card plus a 3% processing fee OR may pay us directly with cash, check or credit card plus a 3% processing fee. A $50.00 fee will be charged for any returned check. WAI reserves the right to charge the invoice amount a 3% surcharge if Bidders have not paid within 10 days of the auction date. No property will be released by WAI unless the Purchase Price has been paid in full and the payment has cleared.
NOTE: The 3% credit card processing fee is not greater than our cost of acceptance.
6 SALES TAX A 6% State of Pennsylvania sales tax will be added to the total purchase price, unless purchased for resale or exempt from tax by other Pennsylvania law. All Bidders who qualify for exemption must file a Sales Tax exemption form with WAI prior to a sale. If bidding through a third-party platform sales tax exemptions MUST BE FILED DIRECTLY WITH that platform per their terms.

9 TITLE TO GOODS & DISPUTES At the fall of the hammer when the Auctioneer says “SOLD” title passes to the Buyer who immediately assumes total and full responsibility for all goods at that time. The Buyer is then responsible for payment for all items regardless if possession is taken at that time. If any dispute arises after the conclusion of the Auction, the records of the Auctioneer and Clerk shall stand as conclusive. Any loss or damage by breakage, natural disaster, theft or any other cause is therefore the sole and entire responsibility of the Buyer.
10 REMOVAL OF GOODS It is the Buyer’s responsibility to remove purchased property. Any items left at the sale site are left there at the Buyer’s risk. All property must be removed from the premises at the risk and expense of the Buyer within 10 business days of the auction or the Buyer may be charged $25 per item per day until removed. If purchased property has not been removed, or WAI has not received shipping instructions within 60 days after the auction date, WAI will consider the items as Abandoned and will be consigned to a future auction without additional notice to the purchaser and/or refund. The Auctioneer assumes no responsibility for abandoned items.
11 ERRORS OR OMISSIONS WAI is not responsible for any typographical or other errors and/or omissions in the catalogue or in any advertising connected to this sale.
