Terms & Conditions: These Terms and Conditions defined by Ness Diamonds are an irrevocable contract between bidders, winning bidders, and Ness Diamonds. Bidders accept and hereby comply to be compelled by all terms and conditions established by Ness Diamonds upon participating in our auctions. Strictly no return, no exchange, and no credit Policy are in effect. All sales are final. All items are sold as-is. If in special cases we will be accepting the return, Ness Diamonds will be deducting a 30% restocking fee. Both Auction Premium and shipping fees are non-refundable. Information presented in the listing is merely for the advantage of the buyer with the best knowledge of the auction house. It is solely the bidders' responsibility to ascertain, check, inspect, and firmly decide prior to bidding on all aspects of the item's conditions. 1. Auction Process: a. All bids placed are binding contracts and cannot be retracted. b. We reserve the right to cancel or reschedule the auction for any reason. c. The highest bidder at the time the auction closes wins the item. d. Bidding increments are set by us and must be followed. 2. Payment: a. All payments must be made in the currency specified in the auction listing ($). b. All buyers must complete payment no more than 3 days after the end of the auction. c. All sales are final. d . We accept various payment methods, and additional fees may apply : Payoneer Paypal Visa/Mastercard International Wire Transfer 3. Shipping and Delivery: a. We will ship the purchased items to the registered address provided by the buyer in the Bidsquare account profile. b. Ness Diamonds ships worldwide. (Exclusions apply) The buyer pays for shipping, tariffs, customs, and duty. At the end of the auction, we will calculate the shipping price and add it to your final invoice. If you win multiple items, we will combine shipping. Ness Diamonds packs each item with professional care using the safest materials. c. We will not take any responsibility for any issues that may occur during shipping. (Issues such as customs issues, stolen items, lost packages, transit delays, damaged packages, open packages, etc.) The buyer acknowledges that he takes full responsibility for the shipping and he/she will have no claims whatsoever to Ness Diamonds in case of any issues that may occur once the package is picked up by the shipping carrier and has left the auction house. c . Please allow 7-14 Business Days for International Shipping time. For your convenience, we will ship with DHL EXPRESS insured and signature required shipping only. d. We will ship only to a verified buyer with a verified credit card and verified address. e. Changes in shipping address or any shipping details will not be permitted after the end of the auction. 6. Chargebacks and Disputes: a. No Credit Card Chargebacks. The buyer agrees that he/she will not, under any circumstances, initiate a credit card chargeback with respect to any purchases at the Auction. The buyer further agrees that if, in violation of these Terms and Conditions, a credit card chargeback is initiated, these Bidder Terms and Conditions will be conclusive evidence of the buyer's agreement not to initiate a credit card chargeback; and the buyer acknowledges and agrees that on the presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse or deny any credit card chargeback, and will re-credit all amounts to or for the account of Auctioneer. If, in violation of these Bidder Terms and Conditions, the buyer initiates a credit card chargeback, even if successful, the buyer will remain liable for all purchases made at the Auction, and the buyer will be responsible for all costs and expenses, including attorneys' fees, incurred by or on behalf of Auctioneer and/or any Seller(s) in challenging the credit card chargeback and in collecting payment. The buyer's agreement not to initiate a credit card chargeback is a condition to the buyer's Registration as a Bidder, and for the privilege of bidding at the Auction, and is being made as an inducement for the Auctioneer to accept the buyer's registration and to permit the buyer to bid at the Auction. The auctioneer (Ness Diamonds) is relying on the buyer's agreement not to initiate a credit card chargeback in accepting the buyer's Bidder Registration and in permitting the buyer to bid at the Auction. 7. Fraud Prevention: a. Any fraudulent activity, including using stolen credit cards, will be reported to the appropriate authorities. b. We employ various fraud prevention measures to ensure the security of the auction. 8. Email List; a. Agreement to Receive Email. The buyer agrees to be added to the email list maintained by Auctioneer. The buyer agrees not to report any email sent by or on behalf of Auctioneer as spam.
