TERMS AND CONDITIONS OF SALE

1.) All items are sold as-is, where-is. By bidding, you acknowledge that you have researched the item as fully as you desire or that you have chosen not to research the item. Written and oral descriptions are our opinions and should not be interpreted as a guarantee. We will call attention to exceptions from expected age deterioration or damage as far as we can. If there is a question in your mind about a particular item, we suggest that you do not bid. 

2.) Items that are being shipped must be paid in full before they will be released for shipping. Fagan Arms will provide packing labor, materials, and shipping at the actual cost.  

3.) All sales are subject to a 25% buyer's premium.

4.) The auctioneer reserves the right to execute reserves or withdraw auction items at its discretion.

5.) These items will be subject to a Michigan sales tax of 6% if shipped to Michigan residents unless a Tax ID number is provided.

6.) Payment is due within 14 days upon receipt of the invoice and must be made by VISA, MasterCard, American Express, or Discover. All invoices will be sent via email on the Monday after the auction. Because email is not always the most reliable method of communication, should you not receive an invoice, please call our offices as soon as possible to inquire about your invoice.

7.) Auctioneer's liability to the buyer resulting in loss or damage shall not exceed the bid amount plus the buyer's premium.
