The buyer accepts the artwork “as is.” In doing so, the buyer waives any and all warranties, including the warranty of merchantability, and the warranty of fitness for a particular purpose. The buyer is purchasing the physical artwork described above for the price listed. The copyright and rights to reproduce the artwork are reserved to the artist and are not transferred upon the sale of the individual artwork identified above. The buyer acknowledges that the price of sale includes any applicable taxes. The buyer agrees to pay the reasonable cost of shipping outside of Miami-Dade County. If the buyer takes possession of the artwork personally, he/she assumes the responsibility of risk for the transportation of the artwork unless explicitly agreed to by the seller and the buyer. The buyer has the duty to arrange transportation, secure insurance for the artwork and obtain suitable packaging material if applicable. The buyer acknowledges that the sale is final, and there shall be no returns, refunds, or exchanges on items purchased. The seller affirms that the above information about the item(s) being sold is true and accurate to the best of their knowledge. The seller makes no warranties, implied or explicit, with respect to the artwork identified herein. In the event of any dispute, the seller stipulates that the laws and regulations of the state of Florida will control. This contract for sale of artwork/goods shall be construed under Florida law.
