Terms & Conditions of Sales Identification: All purchasers are required to register for a bidder number and to provide full name, address & proper verification. Additions to or withdrawal from sale: The auctioneer reserves the right to withdraw from sale any of the items listed, or to sell at this auction items not listed. The auctioneer further reserves the right to group one or more lots into one or more selling lots, or to divide any one lot into two or more selling lots. Whenever the best interest of the seller will be served, the auctioneer reserves the right to sell all of the items listed in bulk. Dispute between bidders: If any dispute arises between two or more bidders, the auctioneer will settle said dispute or may immediately put the disputed lot up for resale to the highest bidder. The decision of the auctioneer shall be final and absolute. Reserve: The auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the auctioneer shall have the right to bid on behalf of the seller. Condition of items sold: The auctioneer shall not be responsible for the correct description, authenticity, genuineness of, or defect in any lot, and makes no warranty in the connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse. Time of payment: All bills must be paid in full before the end of the auction day and prior to shipment to absentee buyer. Manner of payment: All bills must be paid to representatives of the auctioneer at the auction unless otherwise announced. The full purchase price on all lots sold to the same buyer must be paid within the time fixed and before removal of any of the items. Compliance with terms of sale: In default of payment of bills in full within the time herein specified, the auctioneer, in addition to other remedies allowed by law, may retain all moneys received, as deposit or otherwise, as liquidated damages. Lots not paid for and removed within the time specified herein may be resold at public or private sale without further notice, and deficiency, together with all expenses and charges of re-sale, will be charged to the defaulting purchaser. Additional terms and conditions: Any additional terms or conditions of sale, added by auctioneer, shall be announced prior to auction. Removal: Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be delivered only on presentation of paid bill. Auctioneer shall not be responsible for goods not removed with-in the time specified, and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased, but not paid for and removed within the specified time. Non-delivery responsibility: Auctioneer shall not, in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser of the deposit or sum paid on said lot, should the purchaser be entitled to it. Claims: No claims will be allowed after goods are removed from premises. Personal and property risk: Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the auctioneer from liability therefore. Neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held. Records: The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute. Agency: The auctioneer is acting as agent only and is not responsible for acts of its principals. Long Gun Policy: Based on Michigan law, it is our policy that: 1. No firearm will be sold to individuals who are not 21 years of age and a resident of Michigan, Indiana, Ohio (except Columbus) or Wisconsin. 2. No firearm will be sold to anyone not in attendance or personally picking up the gun following successful bidding at the auction. 3. No firearm will be sold to anyone who cannot or will not certify that he/she is not subject to restrictions based on criminal history, mental health history, ​ or other disqualifying factors. 4. No firearms will be sent or transported over state lines by any Americana Auctions personnel or representatives. Shipping Information: Unless otherwise agreed to, all shipping, handling and insurance charges will be the sole responsibility of the successful high bidder. The successful absentee bidder must make full payment for the item prior to shipment of the item to the buyer. Americana Auctions Handgun Policy (Non-Antique or Black Powder) Based in part on Michigan law, Federal Laws as they pertain Sales of Estate handguns, and the Auction policy of Americana Auctions…to it is our policy that: 1. No handgun will be sold to individuals who are not 21 years of age and a resident of Michigan. 2. No handgun will be sold to anyone not in attendance at the auction where the handgun is being sold. 3. No handgun will be sold to anyone who cannot or will not Certify that he/she is not subject to restrictions based on criminal history, mental health history, or other disqualifying factors. 4. No firearms of any variety will be sent or transported over state lines by any Americana Auctions personnel or representatives. 5. Successful bidders must provide proper documentation of permission to purchase or proper carry ​ permits as determined by state law.
